Communication No. 20240627-1 – In relation to the current presence of high-ranking foreign representatives in the Free Territory of Trieste, the Provisional Government recognizes the necessity to provide a clarification on the current legal status of the Free Territory of Trieste, which is still unchanged since September 15, 1947 (Peace Treaty).
Furthermore, the Provisional Government would like to reaffirm that the Free Territory does not belong to any International Governmental Organization (excluding the special relationship with the United Nations) and would like to reaffirm its neutrality – already recognized by the international community – on issues of local and international interest and in all areas both civilian and military. Future decisions can be discussed with the Governor – following His appointment – or with the United Nations Security Council at the present time.
Therefore, the foreign presence within the Free Territory of Trieste does not have the authority to modify the status quo ante, including the impossibility of any membership, association, or adherence to International Governmental Organizations which, even if carried out by foreign state’s authorities on behalf of the Free Territory, are to be considered not to be subjected to the Free Territory of Trieste under any circumstances, unless in cases where such associations are made under the circumstances provided for by the Peace Treaty, with a decision certified by the Security Council and in the period following the entry into force of the Peace Treaty and prior to the current foreign administration that began in 1954.
The Government also would like to take the opportunity to remind the current foreign administration of Zone A of the obligations assumed in the execution of the Peace Treaty, in which the presence of military forces within it constitutes (erga omnes) violations of the treaty itself (obiter dictum) as a self-executing international norm.

Comunicato n. 20 24 06 27-1 – In merito alla odierna presenza di massimi esponenti esteri nel Territorio Libero di Trieste, il Governo Provvisorio ravvisa la necessità di chiarire lo status attuale del Territorio Libero rimasto immutato sin dal 15 Settembre 1947 (Trattato di Pace).
Inoltre, il Governo Provvisorio ribadisce la non appartenenza del Territorio Libero ad alcuna Organizzazione Governativa Internazionale (escluso il rapporto speciale con le Nazioni Unite) e ribadisce la sua neutralità – già riconosciuta dalla comunità internazionale – sui temi di interesse locale ed internazionale ed in ogni ambito, civile e/o militare. Future decisione possono essere discusse con il Governatore – a seguito della Sua nomina – o con il Consiglio di Sicurezza delle Nazioni Unite al momento attuale.
Pertanto, la presenza estera all’interno del Territorio Libero di Trieste non possiede l’autorità per la modifica dello status quo ante, inclusa l’impossibilità di ogni appartenenza, associazione o adesione a organizzazioni internazionali che, anche se effettuati da autorità estere in nome del Territorio Libero, sono da considerarsi non assoggettabili al Territorio Libero di Trieste in nessuna circostanza, tranne nel caso in cui tale associazione sia stata effettuata nelle circostanze prevista dal Trattato di Pace, con decisione asseverata dal Consiglio di Sicurezza e nel periodo successivo all’entrata in vigore del Trattato di Pace e precedente all’attuale amministrazione estera iniziata nel 1954.
Il Governo inoltre vuole ribadire all’attuale amministrazione estera della Zona A gli obblighi assunti all’esecuzione del Trattato di Pace, nei quali la presenza di forze militari al suo interno sono violazioni (erga omnes) del trattato stesso (obiter dictum) quale norma internazionale self-executing.
